1. Acceptance of Terms

By installing, accessing, or using Cabinéo ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legal agreement between you ("Merchant", "you", or "your") and Cabinéo ("we", "us", or "our").

2. Description of Service

Cabinéo provides a virtual try-on feature for Shopify stores, allowing your customers to visualize how clothing items would look on them before purchase. The Service includes:

  • A Shopify app for managing settings and viewing analytics
  • A theme app extension for integrating try-on buttons on product pages
  • AI-powered image generation via third-party services
  • Customer photo processing for try-on generation

3. Eligibility

To use the Service, you must:

  • Have an active Shopify store
  • Be at least 18 years old or the age of majority in your jurisdiction
  • Have the legal authority to enter into binding contracts
  • Comply with all applicable laws and regulations

4. Account and Registration

When you install Cabinéo from the Shopify App Store, your account is automatically created using your Shopify store information. You are responsible for:

  • Maintaining the security of your Shopify account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

5. Subscription and Billing

5.1 Pricing Plans

We offer tiered subscription plans based on monthly try-on usage. Current plans and pricing are displayed in the app and on our website. All prices are in EUR and billed monthly through Shopify.

5.2 Free Trial

New merchants receive a 7-day free trial with full access to all features. You will not be charged until the trial period ends.

5.3 Usage Limits

Each plan includes a monthly quota of try-on generations. If you exceed your quota, the try-on feature will be temporarily unavailable until your billing cycle resets or you upgrade your plan.

5.4 Billing

All billing is handled through Shopify's billing system. Subscriptions renew automatically each month. You may cancel at any time through the Shopify admin.

5.5 Refunds

Due to the nature of the service (AI processing costs are incurred immediately), we generally do not offer refunds for used try-on credits. If you believe you were charged in error, please contact support.

6. Acceptable Use

You agree not to use the Service to:

  • Upload or process illegal, harmful, or offensive content
  • Infringe on intellectual property rights of others
  • Attempt to reverse engineer or exploit the Service
  • Interfere with or disrupt the Service or servers
  • Use automated tools to abuse the Service
  • Resell or redistribute the Service without authorization
  • Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

7.1 Our Rights

The Service, including its design, features, and code, is owned by Cabinéo and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

7.2 Your Content

You retain ownership of your product images and store content. By using the Service, you grant us a limited license to process your content solely for providing the try-on functionality.

7.3 Customer Photos

Customer photos uploaded for try-on generation are processed in real-time and deleted immediately after generation. We do not claim any rights to customer photos.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Third-Party Services

The Service relies on third-party providers for AI processing and infrastructure. While we carefully select our partners, we are not responsible for their actions or service availability.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Try-on results will be accurate or realistic
  • The Service will meet your specific requirements
  • Any defects will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CABINÉO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Cabinéo and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or process through the Service

13. Termination

You may terminate your use of the Service at any time by uninstalling the app from your Shopify store.

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the app. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Paris, France.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cabinéo regarding the Service and supersede any prior agreements.
